§ 5.52.040. Application for massage business establishment license.

  • A.

    Any person desiring to engage in the business, trade, profession, operation or conduct of a massage business establishment must first file an application for a license in the office of the city clerk and pay a nonrefundable annual license fee, which will be one hundred thirty-five dollars ($135.00) per location. The application, once accepted, will be referred to the city police department for investigation of the applicant's character and qualifications. Copies of the application will also be referred to the fire and health departments. The departments may inspect the premises proposed to be operated as a massage business establishment and make written verification to the city clerk concerning compliance with city codes that they administer. Each application must be written on forms provided by the city clerk and contain the following information:

    1.

    Full and true name(s) or any other name(s) used by the applicant (hereinafter all provisions which refer to applicant include an applicant which may be a corporation or partnership).

    a.

    If applicant is a corporation, the names and residence addresses of each officer and director of the corporation and each stockholder owning more than ten (10) percent of the stock of the corporation, and address of the corporation itself, if different from the address of the massage establishment,

    b.

    If applicant is a partnership, the names and residence addresses of each partner, including limited partners, and the address of the partnership itself, if different where the business is to be conducted;

    2.

    Present address and telephone number of each applicant;

    3.

    Location, mailing address and telephone numbers where the business is to be conducted;

    4.

    Two previous addresses immediately prior to the present address of the applicant;

    5.

    Proof that the applicant is at least the age of majority;

    6.

    Applicant's height, weight, color of eyes and hair, and sex;

    7.

    One photograph at least two inches by two inches and a complete set of fingerprints of each applicant. Both the photograph and fingerprints must be taken by the chief of police or his or her agent. The fingerprints and photograph shall be for the purpose of establishing identification of the applicant(s).

    a.

    If applicant is a corporation, one photograph and one complete set of fingerprints must be taken of all officers and managing agents of the corporation,

    b.

    If applicant is a partnership, one photograph and one complete set of fingerprints must be taken of each partner, including limited partners;

    8.

    Driver's license, if any, and date of birth of each applicant;

    9.

    Business, occupation or employment of the applicant for three years immediately preceding the date of application;

    10.

    Massage or similar business license history of each applicant; whether such person, in previously operating in this or another city or state, has had a business license or permit revoked or suspended, reason for the action, and the business activity or occupation subsequent to the action;

    11.

    All criminal convictions other than misdemeanor traffic violations, including dates of convictions, nature of the crimes and place convicted;

    12.

    Names and addresses of each massage therapist who will be employed, or who will be providing services through the proposed massage business establishment;

    13.

    Description of any other business to be operated on the same or on adjoining premises owned or operated by the applicant;

    14.

    Authorization for the city, its agents and employees to seek information and conduct an investigation into the truth of the statements set forth in the application and qualifications of the applicant;

    15.

    Such other identification and information necessary to discover the truth of the matters specified as required to be set forth in the application.

    B.

    Upon completion of the above-provided form and the furnishing of all supplemental information, the city clerk shall accept the application for necessary investigations. The holder of a massage business establishment must notify the city clerk (who in turn will notify the appropriate departments) of each change in any of the data required to be furnished by this section within ten (10) days after any change occurs.
