§ 5.36.120. Amusement rides—Operation requirements.

    Operation Generally. Every owner and licensee shall ensure that all operators have knowledge of the use and function of all normal operating controls, signal systems and safety devices applicable to the ride, and the proper use, function, capacity and speed of the particular ride which is being operated.

    1.

    Controls. An operator must be in the immediate vicinity of the operating controls during operation and have complete control of the ride at all times when it is being operated for the public's use. No person other than the operator may be permitted to handle the controls during normal operation. This provision does not apply to amusement rides designed to be operated or controlled by a passenger. When a ride is closed, provisions must be made to prevent operation by unauthorized persons.

    2.

    Signal Systems. Signal systems must be provided and utilized for controlling, starting and stopping a ride when the operator of the ride does not have a clear view of the point where passengers are loaded or unloaded. Systems will be tested each day before operation. A ride requiring a signal system may not be operated if the system is not performing correctly. Signals for the movement or operation of a ride may not be given until all passengers and other persons who may be endangered are in a position of safety.

    Overspeeding and Overloading. A ride may not be loaded beyond its rated capacity or operated at an unsafe speed or any speed other than that prescribed by the manufacturer. When this information is not obtainable, the criteria for safe operational speeds and rate capacities shall be established by the NAARSO certified inspector, or other expert as may be accepted by the city.

    B.

    Access, Egress and Walking Surfaces.

    Safe and adequate means of access to and egress from rides or temporary structures shall be provided. All accesses and egresses shall have the following: protection from adjacent hazards or from falling by use of guard rails, enclosures, barriers or similar means; secure treading and supporting surface free from debris, obstructions, projections and slipping, tripping and other hazards; adequate clearance.

    All passageways are to be kept free of debris, obstructions, projections and other hazards; surfaces must prevent slipping and tripping, and floors must be kept free of protruding nails, splinters, holes or loose boards. Where mechanical handling equipment is used, sufficient safe clearances must be allowed for passageways.

    C.

    Stairways, Landings and Ramps. Adequate stairways, ramps and necessary landings and platforms shall be provided as follows: (a) where people enter or leave a ride which is above or below grade or floor level, and (b) at the entrance to or the exit from the ride.
